Intellectual Property
Policy for Sellers

Everything you need to know about IP rights, anti-counterfeiting rules, reporting mechanisms, prohibited activities, and seller obligations on BonziCart's marketplace.

Anti-Counterfeiting Copyright & Trademark Infringement Reporting Violations = Account Suspension

Anti-Counterfeiting Policy

Zero tolerance for fake, pirated, or inauthentic products on BonziCart's marketplace.

Products that are pirate copies, illegally replicated, reproduced, or manufactured by infringing another party's intellectual property rights are strictly banned from the BonziCart marketplace. We take authenticity very seriously to protect our customers, sellers, and brand partners.

If you supply unauthentic products, BonziCart may immediately suspend or terminate your selling account and dispose of any inauthentic products found in our fulfillment centers — at your own expense. Payments will be withheld if we determine your account has been used to sell inauthentic goods, commit fraud, or engage in any illegal activity.

BonziCart works closely with manufacturers, authorized distributors, rights holders, content owners, and trusted sellers. We conduct timely reviews of all listed products and reserve the right to remove any product that violates IP rights. We also collaborate with legal advisors and attorneys to take strict action against violators who harm our customers and rights holders.

All products must be genuine, authentic, and sourced from authorized channels.
Listing pirated software, counterfeit goods, or replica products is strictly forbidden.
Sellers must have valid proof of authorization to sell branded goods.
Packaging and labeling must match the authentic product exactly.
Do not alter or remove manufacturer serial numbers, model numbers, or any identifiers.

Report Intellectual Property Infringement

How rights owners and sellers can submit IP complaints to BonziCart.

Brand Registry

If you are the owner of a registered trademark, you are eligible to enroll your brand on BonziCart. Registry grants you access to powerful search tools and authoritative attributes for your brand name, giving you greater control over your product listings.

Who Can Report

To file an infringement report, you must be the registered owner of the right or an authentic authorized agent holding written approval from the owner.

Owners who are not registered on BonziCart can send an email to our IP team if they discover their content or product has been infringed. You may submit complaints for trademark, copyright, patent, or other IP claims with full details of the infringing party.

Best Practice

Send only one type of IP violation per notice. Our team processes the specific complaint type mentioned in the infringement report — mixing claim types causes delays.

What to Include in Your Report

1

Your Identity & Authorization

Full name, company name, contact details, and written authorization if acting as an agent.

2

Description of the IP Right

Specify the exact trademark, copyright, patent number, or trade secret at issue, including registration numbers and jurisdiction.

3

Location of the Infringing Content

Provide the exact product listing URL(s), ASIN(s), or page references where the infringement appears.

4

Statement of Good Faith

Affirm that the information is accurate and that you have a good faith belief that the use is unauthorized.

5

Electronic or Physical Signature

Your signature (or that of the authorized agent) is required for the complaint to be valid.

Items Not Covered by IP Enforcement

Certain codes, images, and distribution agreements fall outside BonziCart's IP enforcement scope.

Barcodes, EANs & UPCs — These are used to store product information like pricing and inventory levels. They do not carry intellectual property protection and are not enforced.
Catalog Image Rights — When you create a product detail page, it remains in our catalog. If you add a copyrighted image to such a listing, you grant BonziCart and its affiliates a non-exclusive, worldwide license to use that image as part of marketing activities.
Exclusive Distribution Agreements — While we respect a manufacturer's right to enter exclusive distribution agreements, BonziCart does not enforce such agreements as an IP matter. Enforcement remains a private matter between the manufacturer and retailers.
Generic Product Information — Standard product descriptions, dimensions, and technical specifications that are factual in nature are not protected under IP law and are not enforced.

™

Trademark

A recognizable sign, design, or expression that identifies products or services from a specific source.

Trademark Details

Trademarks protect brand names, logos, slogans, and distinctive marks. The owner may be an individual, business, or legal entity. On BonziCart, you cannot use another brand's trademark in your product title, description, or images without authorization. Infringement results in listing removal.

©

Copyright

Exclusive rights granted to creators of original literary, artistic, or musical works.

Copyright Details

Copyright protects original expressions in creative works for a limited time. Protection is country-specific. To sell on BonziCart, use only your own copyrighted images in product listings. Taking images from other sources without permission is not allowed and constitutes infringement.

Patent

Exclusive rights granted for an invention — a product or process that provides a new way of doing something.

Patent Details

Patents grant the inventor exclusive rights to make, use, sell, or import an invention for 20 years. Selling patented products without the patent holder's authorization is infringement. Sellers must ensure their products do not violate existing patents in any relevant jurisdiction.

Trade Secrets

Confidential business information that provides a company with a competitive edge.

Trade Secret Details

Trade secrets include formulas, processes, designs, or methods kept confidential. Sellers must not disclose or use trade secrets of other parties in their products or listings. Misappropriation of trade secrets may result in civil and criminal liability under applicable law.

Industrial Design

Protection for the visual appearance or aesthetic features of a product.

Design Right Details

Industrial design rights protect the ornamental or aesthetic aspects of a product — such as shapes, colours, or textures. Copying the distinctive appearance of a competitor's product without authorization constitutes design infringement on BonziCart.

Geographical Indication

A sign used on products with a specific geographical origin that have a quality or reputation linked to that origin.

GI Details

Geographical Indications (GIs) protect products like Darjeeling Tea, Kanchipuram Silk, or Basmati Rice. Misusing GI tags by falsely claiming regional origin is an infringement of intellectual property rights and is strictly prohibited on BonziCart.

Intellectual Property for Rights Owners

How BonziCart protects your IP and what rights owners can do if infringement is found.

BonziCart is committed to ensuring that goods listed on our platform do not violate or infringe an owner's intellectual property rights. Rights owners can report any content or product they believe is infringing their IP. If you have specific questions about the infringement of your IP, we strongly advise consulting a licensed attorney.

Reporting Infringement

To report an infringement, you must be the owner of the right or an authentic, authorized agent with written approval from the owner. False or fraudulent claims may expose you to legal liability.

Owners not registered on BonziCart can email our IP team directly.
Submit trademark, copyright, patent, or other IP claims with full details.
BonziCart will review all claims within 5–7 business days.
Verified claims result in immediate listing suspension pending investigation.
Rights owners receive a confirmation email once their claim is processed.
Repeat infringers are permanently banned from the marketplace.

DMCA & Takedown Process Detailed

Step-by-step process BonziCart follows when a valid IP takedown notice is submitted.

DMCA Compliance

BonziCart follows the Digital Millennium Copyright Act (DMCA) framework as well as applicable Indian IT Act provisions for handling intellectual property takedown requests.

Step 01
Submit Takedown Notice
The rights owner or authorized agent submits a valid, signed IP infringement notice via email to [email protected] with all required details (identity, IP right, infringing URL, good faith statement).
Step 02
Initial Review (1–2 Business Days)
BonziCart's IP compliance team reviews the notice for completeness and validity. Incomplete notices are returned to the complainant for correction. Valid notices are logged in our system and assigned a case number.
Step 03
Listing Suspension
Upon receiving a valid takedown notice, the accused listing is immediately suspended pending investigation. The seller is notified via email with the case reference number and reason for suspension.
Step 04
Seller Notification & Counter-Notice Window
The accused seller has 10 business days to submit a counter-notice if they believe the claim is erroneous. Counter-notices must include a statement of good faith, accurate product sourcing documentation, and a signed declaration.
Step 05
Investigation & Decision
BonziCart evaluates both the takedown notice and any counter-notice. Our legal team may request additional documentation. A decision is reached within 5–7 business days after the counter-notice period closes.
Step 06
Outcome & Enforcement
If infringement is confirmed, the listing is permanently removed, the seller receives a policy violation strike, and proceeds from infringing sales may be withheld. Repeat offenders face permanent account termination and referral to law enforcement.

Appeal & Reinstatement Process New

If you believe your listing or account was wrongly suspended, here's how to appeal.

BonziCart recognizes that IP complaints can sometimes be filed in error or in bad faith. Sellers who believe their listing was wrongly removed have the right to submit a formal appeal. The appeal process is designed to be fair, transparent, and timely.

1

Submit a Counter-Notice

File within 10 business days of receiving the suspension notice. Include your full contact details, the case reference number, a description of the authentic product with sourcing documents (invoice, authorization letter, brand certificate), and a signed good-faith declaration.

2

Provide Supporting Documentation

Attach purchase invoices, manufacturer authorization letters, brand registry certificates, or any documentation proving your right to sell the product. BonziCart will not reinstate listings without adequate proof of authorization.

3

Wait for Legal Review

BonziCart's legal team will review your counter-notice and documentation within 7–10 business days. You will receive an email update on the status of your appeal.

4

Escalation to Dispute Resolution

If the original complainant withdraws the notice or if BonziCart determines the claim was invalid, your listing will be reinstated and any withheld payments will be released within 5–10 business days.

5

Bad-Faith Complaints

Submitting a false or fraudulent IP claim against a competitor is a serious violation. BonziCart will take action against complainants who abuse the IP reporting system, including suspension of their own account and referral to authorities.

Time Limit

Appeal submissions must be made within 10 business days of receiving a suspension notice. Appeals filed after this window may not be considered.

Selling Policies & Seller Code of Conduct

The standards every BonziCart seller must uphold to maintain a trustworthy marketplace.

Our marketplace provides sellers a platform to reach millions of customers. We believe in a trustworthy buyer and seller experience. Vendors must abide by our policies and guidelines — violations may result in listing termination or account suspension.

1

Maintain Current Account Information

Keep all account details accurate, up to date, and consistent with your registered legal entity. False or misleading business information is grounds for immediate suspension.

2

Never Misrepresent Yourself

Do not impersonate other sellers, brands, or representatives. Sellers must not falsely claim brand authorization or misrepresent product origins, features, or benefits.

3

Ensure Trustworthy Customer Experience

Act in a manner that ensures a trustworthy experience for customers. This includes honest product descriptions, accurate images, fair pricing, and prompt order fulfillment.

4

No Harmful Products

Listing products that cause physical, emotional, or financial harm to customers is strictly prohibited. This includes dangerous, recalled, or unregulated products.

5

No Misleading or Inappropriate Behavior

Engaging in misleading, inappropriate, or deceptive behavior — including in your account details, listings, content, images, videos, and communications — constitutes a code of conduct breach.

6

No Review Manipulation

Do not perform actions that lead to manipulation of customer reviews, including showcasing false or misleading unauthentic content. Incentivized or biased reviews are strictly forbidden.

7

Respect Competitor Listings

Performing actions that intentionally damage another seller's listing, brand, or rating are against the code of conduct. Unfair competitive practices will result in immediate action.

8

Comply with All Applicable Laws

Sellers must follow all applicable local, state, national, and international laws relevant to their business, including consumer protection, tax, import/export, and product safety regulations.

Prohibited Seller Activities & Operations

Actions that violate BonziCart's policies and result in penalties, suspension, or termination.

Policy Breach Notice

Violation of any prohibited activity may result in cancellation of listings, suspension of seller account, forfeiture of payments, and legal referral. These policies exist to maintain a safe marketplace for everyone.

Diverting Transactions

Any attempt to divert transactions or buyers to external sites, including competitor marketing, constitutes policy breach and leads to immediate contract termination.

Improper Business Names

Your business name must be unique and not include misleading information, trademarked terms, or email suffixes (.com, .net, .biz). It must not infringe the IP rights of any other party.

Inappropriate Email Communications

Sending unsolicited marketing or promotional emails to BonziCart customers is prohibited. Sellers may only send emails related to order fulfillment and customer service.

Misuse of Customer Phone Numbers

Phone numbers provided to sellers for carrier label issues must not be used for marketing or shared with external parties. Never call customers unnecessarily.

Multiple Seller Accounts

A seller cannot maintain multiple selling accounts without written approval from BonziCart. Submit a legitimate business request if you require additional accounts.

Misuse of Selling Services

Excessive or redundant use of BonziCart's seller tools that negatively impacts platform performance will result in access restrictions or temporary account suspension.

Review & Rating Manipulation

Manipulating ratings, feedback, or reviews — including self-reviews, competitor review attacks, or incentivized feedback — is strictly prohibited and results in immediate suspension.

Artificial Traffic Simulation

Using bots or automated tools to artificially simulate web traffic, inflate page views, or manipulate search rankings is a code of conduct breach.

Price Manipulation

Selling prices cannot be increased after a buyer transaction. Sellers cannot set unreasonably high shipping costs to circumvent pricing policies. Always comply with BonziCart's fair pricing policy.

Keeping Your Account Secure

Best practices to protect your BonziCart seller account from unauthorized access and threats.

Account security is critical to your business. A compromised seller account can be used to list inauthentic goods, causing IP violations that damage your reputation and business. Follow these best practices to keep your account safe.

Two-Step Verification

Always enable 2FA on your BonziCart seller account. This is the single most effective way to prevent unauthorized access.

Strong Passwords

Use long passwords with mixed letters, numbers, and special characters. Never use personal data like phone numbers or birth dates.

Regular Password Changes

Change your password every 90 days. Timely rotation significantly reduces risk if a password is compromised.

Unique Passwords

Use different passwords for each platform. Never reuse your BonziCart password on any other site or service.

Clear Cache Regularly

Regularly clear your browser cache and cookies, especially when using shared or public computers.

Monitor Login Alerts

Enable login notifications in your account settings. Report suspicious login activity to BonziCart support immediately.

Sub-Account Access Control

Grant sub-account access only to trusted staff. Revoke access immediately when employees leave your organization.

Beware of Phishing

BonziCart will never ask for your password via email. Ignore and report suspicious links or requests for credentials.

Best Practices & Additional Recommendations

Practical guidance to help sellers maintain compliance and build a reputable business on BonziCart.

Accurate Product Descriptions: The product listed on a detail page must accurately describe all attributes — manufacturer, edition, version, compatibility, expiry date (if applicable), warranty, and other specifications.
Fair Pricing: Selling prices cannot be increased after a buyer transaction. Do not set inflated shipping costs. Always comply with BonziCart's fair pricing policy.
No Duplicate Pages: Creating a duplicate product detail page for an existing product is not allowed. Separate listings for products with similar features are prohibited.
Use Original Images: Only use product images you own or have explicit permission to use. Never copy images from competitors, manufacturer websites, or image libraries without authorization.
Keep Invoices Ready: Maintain all procurement invoices and supplier authorization letters. These are essential if an IP claim is ever filed against your listings.
Brand Authorization: If you are an authorized reseller of a brand, keep your authorization letter on file and update it annually. Upload it to your seller account for faster dispute resolution.
Stay Updated on IP Laws: Intellectual property laws change frequently. Subscribe to BonziCart's seller newsletter and consult a legal advisor to stay compliant with the latest regulations.
Honest Reviews Only: Encourage genuine customer reviews through good service. Never solicit, purchase, or manipulate reviews. Organic feedback builds long-term trust and better rankings.

Additional Guidelines for Service Providers

Specific rules for sellers who offer services (rather than physical products) on BonziCart.

Service providers must conduct the service exactly as described in their scope of work on the service detail page.
Services must be provided on the date of purchase. If the service will be delayed, the customer must be informed proactively and in advance.
Service providers must not request additional products, parts, or service orders before or during the service call unless explicitly authorized by the customer.
If the customer requests services or product parts outside the scope of your facilities, the service provider may fulfill the request and charge the customer accordingly — with prior approval.
Sending non-approved technicians for in-house services will result in immediate cancellation of your service privileges on BonziCart.
All technicians and service staff must carry valid ID and authorization documents during service visits.
Any proprietary information, trade secrets, or confidential data encountered during a service visit must be kept strictly confidential and not disclosed or misused.
Service providers must maintain adequate liability insurance for all in-home or on-site services provided through BonziCart's platform.

Frequently Asked Questions

Common seller questions about intellectual property policies on BonziCart.

If you believe an IP complaint was filed in bad faith or fraudulently, submit a counter-notice within 10 business days with evidence supporting your right to sell the product. BonziCart investigates all counter-notices and takes action against complainants who abuse the IP reporting system, including suspending their accounts.
Generally, reselling authentic branded products purchased at retail is permitted under the "first sale doctrine." However, some brands enforce exclusive distribution agreements. You should keep your purchase receipts as proof of authenticity. If a brand files an IP claim, your receipts will be your primary defense.
Inspiration is fine, but copying is not. You may not use brand names, logos, distinctive patterns, or designs in your products or listings without authorization. "Inspired by" products that are clearly different and do not cause consumer confusion may be permissible, but we recommend consulting an IP attorney before listing such products.
Initial review takes 1–2 business days. Listings may be suspended during this period. If a counter-notice is submitted, BonziCart allows up to 10 business days for the counter-notice window, then 5–7 additional business days for investigation and final decision. Total resolution time is typically 15–20 business days.
Yes. Filing false or fraudulent IP complaints is a serious violation of BonziCart's policies. Complainants who abuse the IP reporting system may face account suspension, removal from BonziCart's platform, and referral to relevant legal authorities. BonziCart has a zero-tolerance policy for bad-faith IP claims.
Only if you have explicit written permission from the manufacturer to use their images. Many manufacturers provide authorized resellers with image packs. Without permission, using images from a manufacturer's website constitutes copyright infringement. Always obtain written authorization before using third-party product images.
A policy strike is a formal warning recorded against your seller account for violating BonziCart's policies. Accumulating 3 strikes within a 12-month period may result in account suspension. Serious violations (like selling counterfeit goods) may result in immediate termination without prior strikes. Each strike and the reason for it is communicated via email.
To enroll in BonziCart's Brand Registry, you need an active registered trademark in the relevant jurisdiction. Visit the Brand Registry section of the Seller Center, provide your trademark registration number, and complete the verification process. Once approved, you'll have enhanced search tools and greater control over your product listings.
